This position may be eligible for telework for applicants who reside in Minnesota (or a bordering state within 50 miles of the office location). This position exists to provide legal expertise to MNsure. The individual in this position will be responsible for providing legal advice and counsel on MNsure legal activities including advising MNsure managers, directors and executive management and coordinating with other agency legal counsel, and the Attorney General’s office. This position directs and coordinates a variety of complex and challenging areas affecting MNsure, and in particular in the areas of contracts, procurement, data privacy functions, state and federal healthcare policy, administrative policies, training and legal advice including:
+ Advise MNsure on legal issues and risk to ensure compliance with applicable laws and policies.
+ Provide legal research and advice to support department operations, activities, and transactions.
+ Provide legal guidance and review to the Privacy Officer to ensure Data Practices compliance to support MNsure’s Privacy Officer.
+ Perform a variety of legal services in multiple substantive areas of law to support MNsure’s mission and vision.
+ Use subject-matter knowledge, as well as knowledge of statutory construction principles, to review and provide an analysis of legislative proposals and proposed rules, at both the state and federal level.
+ Concisely describe the impact of proposed legislation on the department and its programs. Provide testimony and information to legislators in areas of expertise, as requested by MNsure Public Affairs.
+ Draft MNsure comments on proposed regulatory actions.
+ Assist in drafting proposed legislation.
+ Coordinate General Counsel’s Office fiscal note review and identify potential fiscal impacts.
+ Requires in-depth understanding of state and federal legislative processes, procedures, and functions.
**Minimum Qualifications**
+ Four (4) years of career experience as a practicing attorney in an area of law related to the position.
+ Juris Doctor (JD) degree from an ABA accredited law school.
+ Current license and in good standing to practice law in Minnesota.
Experience must demonstrate the following:
+ Ability to deliver effective verbal or written messages that facilitate a mutual understanding on both parties.
+ Experience with contract negotiations and contract law including drafting requests for proposal, professional/technical contracts and grants, data sharing agreements, and other legally binding agreements to ensure compliance with laws and regulations.
+ Strong critical thinking and problem-solving skills with ability to interpret complex legal exceptions and exemptions to provide sound, accurate, and practical legal advice.
**Preferred Qualifications**
+ Communicate with a variety of professional and lay persons complex legal topics; identify, articulate, analyze, and resolve complex problems having short- and long-term implications
+ Knowledge of state and federal legislative processes, procedures and functions.
+ Ability to make clear and sound recommendations to leadership who depend on accurate, objective, insightful and timely analyses and recommendations.
+ Ability to manage multiple concurrent projects and competing priorities under demanding deadlines.
