Job Description

Old Mutual Finance was established in 2008 to provide unsecured lending products and services to the SA market. The business started with a staff compliment of 34 and has since grown to over 3000 staff with more than 300 branches nationally. Within our branches we offer insurance, lending products as well as servicing.

We are recruiting for a Legal Advisor, Advanced. This role will report into the Head of Legal.

This is a specialist legal role, the role will be responsible for the following:

• Drafting and reviewing of commercial agreements.
• Accumulates all the pertinent facts identifies relevant issues researches applicable legal principles and applies them to the facts.
• Assesses and picks up on trends and patterns and makes recommendations.
• Provides company secretarial assistance and other assistance as required.
• Provides legal opinions/comments on legislation.
• Provides legal compliance support.

Responsibilities

Legal:
Negotiating and advising on a wide range of commercial agreements, including agreements for the distribution of financial products.

Information and Business Advice:
Provide specialist advice in respect of:

Applicable legislation, including National Credit Act, Companies Act, Protection of Personal Information Act, Financial Advisory and Intermediary Services Act and Financial Intelligence Centre Act.

The law of contract and corporate governance.

The interpretation and application of policies and procedures, resolving complex or contentious queries and issues and enabling others to take appropriate actions.

Collaborating with cross-functional teams to identify and mitigate legal risks.

Document Preparation:
Write and edit material for various target populations, tailoring the tone and content to match the needs and expectations of each audience.
Drafting and reviewing of commercial agreements through collaboration with various stakeholders in the business to understand the goal of such agreements.

Commercial acumen:
Developing and implementing effective legal strategies to support business growth and expansion.

Internal Communications:

Develop and/or deliver a plan for significant aspects of internal communications with guidance from senior colleagues.

External Communications:

Manage certain aspects of the external communications system with some guidance from senior colleagues. This could mean being responsible for the development or operation of the system.

Recommendations:

Advise others on how to design new processes and systems that meet professional standards.

Solutions Analysis:

Identify and evaluate complex, expertise-led solutions against a range of criteria to find the ones that best meet business needs.

Policy Development and Implementation:

Develop procedures and interpret and apply policy for area of expertise to achieve specified outputs, or advise the wider business on application of policy, then monitor implementation of those procedures within the organization.

Internal Client Relationship Management:

Manage relationships with internal clients and act as a business partner to them, building high levels of professional credibility and mutual trust, and managing the deployment of appropriate internal and/or external resources to support in delivering business strategy and plans.

Personal Capability Building:

Act as subject matter expert in an area of personal information processing, information technology, policy and regulation. Maintain external accreditations and in-depth understanding of current and emerging external regulation and industry best practices through continuing professional development, attending conferences, and reading specialist media.

Minimum Requirements:

LLB Degree

5+ years experience in a similar role

Experience in financial services industry
