Duties Description • Perform independent legal research, including locating statutes, caselaw, and bill jackets. Provide written analysis and summarization.• Prepare routine correspondence; collect and analyze data; assist in the preparation, review, and evaluation of a variety of reports and records.• Review and organize court decisions and prepare written case summaries.• Serve as the point of contact and coordinator for appropriations claims.• Serve as torts claims process coordinator.• Assist and update attorneys on Department Contract Review Unit matters, including drafting correspondence, receiving and distributing reports, and tracking contracts and contractor status.• Track liens filed against the Department.• Provide administrative assistance to Office of Legal Affairs staff, including handling internal and external inquiries and requests via phone, e-mail, and written correspondence.• Complete assignments involving independent preparation of written materials, reports, and analysis of information.• Assist with the monitoring, review, and analysis of State and Federal legislation.• Review and compile records in response to FOIL, subpoena, and discovery requests.• Receive, maintain, and survey program areas regarding bankruptcy notices and records.• Implement litigation holds as directed by Department attorneys and Claims Engineers.• Draft correspondence and notifications to State Contractors and Insurance companies regarding contractually required state indemnification.• Assign small claims to attorneys, assist in small claims investigations and processing.• Create and maintain departmental databases with relation to legislation, appropriations, torts, small claims, and litigation holds.Responsibilities may include serving a role within the Incident Command System to support the department’s response to regional and statewide emergency situations.
Minimum Qualifications This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS).* To be considered for appointment through NY HELPS, or 55 b/c, candidates must meet the minimum qualifications for this position. The qualifications are:Promotional: One year of permanent competitive or 55-b/55-c service as a Legal Assistant 1. Open Competitive: Three years of full-time experience as a Paralegal/Legal Assistant (see “definition” below). Definition: a Paralegal/Legal Assistant is someone who applies knowledge of the law and legal procedures in rendering direct assistance to lawyers, clients, and courts; prepares and interprets legal documents and forms; researches, compiles, and uses information from legal materials to provide both written and verbal comments on their findings; and analyzes and handles routine procedural problems independently with minimal attorney oversight. Examples of non-qualifying experience: receptionist, records clerk, bookkeeper, office manager. Substitution: An associate degree (or higher) in paralegal/legal assistant/legal studies program or a certificate in a paralegal/legal assistant/legal studies program where the degree was granted from a regionally accredited college or university, or one approved by the American Bar Association (ABA) AND one year of experience as a Paralegal/Legal Assistant (see definition in MQs) OR an associate degree in any field where the degree was granted from a regionally accredited college or university, or one approved by the American Bar Association(ABA) AND two years of experience as a Paralegal/Legal Assistant (see definition in MQs) OR graduation from an accredited (ABA approved) law school with a degree required for NYS Bar will be accepted AND two years of full-time experience as a Paralegal/Legal Assistant (see definition in MQs). Candidates may also be qualified for permanent competitive appointment if reachable from the appropriate Civil Service eligible list or eligible for reassignment or transfer in accordance with Civil Service Law. If there are three or fewer qualified candidates interested in appointment to this position, a permanent appointment may be made pursuant to Section 52.7 of the Civil Service Law. To be eligible, candidates must be an employee of the Department of Transportation and have one year of permanent competitive service as a Legal Assistant 1, SG-14.
Additional Comments *This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS). For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply. At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified. Employees appointed via the NY HELPS program are restricted for promotional appointment until their position is covered-in to the competitive class by the New York State Civil Service Commission (CSC), or they otherwise obtain permanent competitive status. The CSC has recently covered-in employees who were appointed via NY HELPS on a permanent or contingent permanent basis between June 26, 2024 and June 11, 2025. Notification to employees regarding a change in their status is forthcoming.
