Duties Description Reporting directly to the Secretary of State, the General Counsel provides legal advice and counsel to the Secretary and the Department of State (DOS) Executive Team. Working closely with DOS leadership, the General Counsel manages the Office of General Counsel, which provides legal support to all program and administrative offices within the Department. DOS is an agency with diverse responsibilities, including occupational licensing, consumer protection, building standards and codes, local government assistance, planning and development, coastal zone management, combative sports, assistance to New Americans, and poverty reduction programs. The General Counsel manages all litigation involving the Department and serves as the DOS Ethics Officer. The General Counsel will also be exposed to a wide range of issues, State policy initiatives, and regulatory processes, and must be prepared to work in a fast-paced environment. This position is overtime ineligible and will require availability outside of normal business hours including nights and weekends.The General Counsel’s duties will include but are not limited to the following:• Assists the Secretary of State on legal matters associated with the diverse programs of the Department• Provides legal advice and guidance on legal matters including, but not limited to contracts, ethics, Freedom of Information Law, preparation of agreements, litigation, administrative proceedings, legislation, regulations, and compliance with statutes and regulations affecting the Department.• Serves as the Department’s primary legal liaison with the Executive Chamber, Executive Branch agencies, the Office of the Attorney General, and other governmental agencies in connection with significant legal, legislative, regulatory, and other matters of mutual interest.• Directs the work of the Office of General Counsel.• Collaborates with legal staff in other agencies on behalf of the Secretary of State on new and ongoing programs and initiatives.• Directs the preparation of legislation introduced by the Department.• Directs the review and evaluation of legislation introduced by other parties and advises the Secretary of State and the DOS Executive Team on the potential impact on the Department of State.• Represents the Department’s interests in all legal matters.• Serves as the DOS Ethics Officer, providing ethics opinions upon request.
Minimum Qualifications Doctor of Jurisprudence (J.D.) degree from an accredited law school and admission to the bar of New York State, and at least 9 years of post-bar legal experience, including at least 5 years of managerial experience, preferably in the public sector.• Candidates should have a broad experience in one or more of the following areas of legal practice: administrative, state constitutional law, environmental, energy, land use, consumer protection, labor and employment law, local government, building codes, licensing, and/or business law.• Candidates should also have experience with government work, administrative hearings or litigation, analyzing legal issues, researching and interpreting complex areas of law, and drafting and reviewing legislation and regulations.• Candidates must have strong oral and written communication skills, experience managing legal staff, and the ability to develop and maintain strong professional relationships.PREFERRED QUALIFICATIONS:• Significant experience with litigation, analyzing legal issues, and researching and interpreting complex areas of law• Experience with review of legal work products for quality, accuracy and thoroughness• Experience with research, review, and interpretation of case law and history, and application of such to the professional development of legal staff• 6+ years of management experience with teams greater than 15 professional legal staff, including supervision, training, and professional development, employee performance evaluation, development of policies and procedures, and development of mission, goals, and operational plans.Please forward your transcripts or degree with your resume and cover letter.It is essential that candidates clearly and concisely indicate exactly how they meet the above minimum qualifications in their resume.
